Copyright Policy

RadimySM is designed for talk, commentary, interview, and discussion content. Music-focused stations are prohibited. See our Terms of Use for details on acceptable music use.

1. Copyright Compliance

RadimySM respects intellectual property rights and expects all station hosts to do the same. You are responsible for ensuring all content you broadcast complies with copyright law.

2. Your Responsibility as a Station Host

2.1 Talk Content

As a talk radio platform, most of your content should be original spoken content created by you and your co-hosts. You are responsible for:

  • Ensuring you have the right to broadcast any pre-recorded audio clips
  • Using copyrighted clips only under fair use (commentary, criticism, news reporting)
  • Obtaining permission for any third-party content that doesn't qualify as fair use

2.2 Music and Audio

Music is permitted only as incidental content (intros, outros, transitions). You are solely responsible for ensuring all music and audio content is properly licensed or royalty-free.

Acceptable sources include:

  • Royalty-free music libraries (e.g., Epidemic Sound, Artlist, YouTube Audio Library)
  • Public domain music
  • Music you created yourself
  • Licensed music (if you hold appropriate performance rights licenses)

RadimySM does not provide music licenses. If you play copyrighted music, you must obtain licenses from:

  • Performance rights organizations (ASCAP, BMI, SESAC) for the right to publicly perform musical compositions
  • Sound recording copyright holders for the right to broadcast specific recordings

3. Fair Use

Fair use allows limited use of copyrighted material without permission for purposes such as commentary, criticism, news reporting, teaching, or research. When using copyrighted clips under fair use:

  • Use only short clips necessary for your commentary
  • Transform the content by adding your own analysis or criticism
  • Do not use clips as a substitute for the original work
  • Provide context and commentary around the clip

Note: Fair use is a legal defense, not a guaranteed right. If you receive a copyright complaint, you may need to defend your use in court. Use fair use responsibly.

4. DMCA Compliance

4.1 Copyright Complaints

We comply with the Digital Millennium Copyright Act (DMCA). If we receive a valid DMCA takedown notice regarding your content:

  • We will investigate the complaint promptly
  • We may temporarily suspend your station during investigation
  • We may remove the infringing content
  • You will be notified of the complaint

4.2 Counter-Notification

If you believe a DMCA takedown was made in error (e.g., you have a license or your use qualifies as fair use), you may submit a counter-notification. We will provide instructions if this situation arises.

5. Repeat Infringers

We maintain a policy of terminating accounts of repeat copyright infringers. If your account receives multiple valid copyright complaints, your account will be permanently terminated.

What counts as a violation:

  • Receiving a valid DMCA takedown notice
  • Operating a music-focused station (prohibited under our Terms of Use)
  • Broadcasting copyrighted content without proper licensing
  • Failing to respond to copyright complaints

6. Reporting Copyright Infringement

If you believe content on RadimySM infringes your copyright, please send a DMCA takedown notice to:

Your notice must include:

  • Your contact information (name, address, email, phone)
  • Identification of the copyrighted work being infringed
  • Identification of the infringing material (station name, URL, timestamp if applicable)
  • A statement that you have a good faith belief the use is not authorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

7. Best Practices for Station Hosts

Recommendations to Avoid Copyright Issues:

  • ✅ Focus on original talk content (your voice, your opinions, your interviews)
  • ✅ Use royalty-free music for intros/outros (many free options available)
  • ✅ Keep music clips short and incidental to your talk content
  • ✅ When using copyrighted clips, add substantial commentary and criticism
  • ✅ Credit sources when using clips or quotes
  • ✅ If unsure, don't use it - create your own content instead
  • ❌ Don't play full songs or extended music segments
  • ❌ Don't operate a music-focused station (prohibited)
  • ❌ Don't assume "I'm not making money" means it's okay (it doesn't)
